課程概述

羅爾斯(John Rawls)的政治哲學對當代自由主義、分配正義理論、民主理論以及許多法律與社會議題研究，產生廣泛且深遠的影響。他的正義理論發展可分為三個時期。前期以1971年的《正義論》(A Theory of Justice)為代表，他從批判效益主義出發，進而建構自己的社會正義理論「作為公平的正義」(justice as fairness)。中期以《正義論》之後發表的一系列論文和1993年的《政治自由主義》(Political Liberalism)為代表，他澄清並修正自己的理論，提出交疊共識(overlapping consensus)和公共理性(public reason)的概念。後期則以《政治自由主義》之後發表的論文和1999年的《萬民法》(The Law of People)為代表，除了擴充公共理性概念的內涵，還提出適用於國際社會的正義理論。

本課程將閱讀與評析羅爾斯政治哲學的幾個重要觀點，首先是原初立場(original position)的設計，其次是其社會正義理論的三個主要概念，包括：對的優先性(the priority of right)、交疊共識和公共理性。最後，我們將探討羅爾斯的國際正義理論。 

課程目標
 本課程欲透過閱讀羅爾斯的著作原典及評論文獻，帶領學生瞭解他的政治哲學理論、相關批判及其理論對當代哲學的影響。此外，將透過課堂討論、口頭報告與個人報告之撰寫，提昇學生的表達、論證建構與學術研究之能力。 
課程要求
 1.課前閱讀與提問：須於課前閱讀各週指定閱讀文本內容，掌握問題意識與理論主張，並提出自己的疑問和批判。
2.課堂報告與討論：每週由一位學生口頭報告該週指定閱讀文本之要點，一位學生帶領討論相關理論主張、詮釋與批判之合理性。
3.撰寫期末報告：須針對授課內容，自選研究主題，撰寫學術性論文。

 課前準備與課堂參與

 應於課前仔細閱讀各週指定閱讀文本，並對其中觀點提出至少兩個疑問、批判或延伸問題，於每週一晚上22:00前在NTU COOL課程網頁「討論區」以發佈貼文方式繳交。此外，應準時出席並積極參與課堂討論。如果無法來上課，須事先向教師請假。 
2. 
 口頭報告與討論帶領 
30% 
 每位學生選擇兩週主題做口頭報告，並選擇兩週主題，負責帶領問題討論。報告者須提供綱要電子檔（3頁以內），於每週二早上8:00前上傳至課程網頁「討論區」。報告與紙本綱要的內容包括：(1)要旨與論證：本文的核心問題意識和論證結構為何？作者提出哪些論點？他給出哪些理由來支持這些論點？(2)對論證的評估與批判：作者的論點是否合理？嘗試提出詮釋、挑戰和回應。(3)疑惑不解之處：有哪些概念或論證不清楚或不瞭解？(4)值得進一步討論的延伸問題：相關理論或應用層面的延伸問題。

 期末報告 
40% 
 針對課程內容自選研究主題，於第16週口頭報告研究主題與綱要，於1/2（週二）22:00前將報告上傳至課程網頁作業區（遲交會扣分）。 報告須以哲學學術性論文的形式撰寫，論文體例則依據《國立臺灣大學哲學論評》的論文寫作格式。 篇幅：大學生4000字（英文2300字），碩士生6000-8000字（英文3500-4600字），博士生8000-10,000字（英文4600-5800字）。
